I think this argument is missing a very important detail, the games branding , joy of creation can't sue fnaf on copying gameplay because fnaf is not infringing on that to begin with, if that's the case the first ever game with 3d moment has a claim on every other game with 3d moment, and secondly fnaf is a established brand that joy of creation is by legal definition copying.
