Company’s can have the same name as long as they are in different distinguishable categories, and the clothing brand didn’t also list skincare as a product in their categories on their trademark application with USPTO.

Dang I must be mean cause I truly don't care. If Hailey can learn from this then that's good, but this defiently doesn't make her evil. Moreso just ignorant for going through with it. I however can differentiate between Rhode skincare and the clothing line. Nothing confusing about this. She's young and will learn... sometimes we do things knowing it's wrong and need someone to slap us upside the head until we get it right lol. The small buisness didn't seem extremely angry.. just simply protecting the name.

The point is it can confuse people. Rhode clothing company already has a market base and has built its credibility for three years and by serving big names. She's leveraging over their name by creating a brand with a similar name.

People could easily psychologically associate rhode the skincare company with Rhode the clothing company and give it the credibility it didn't earn.

And also in case rhode skincare disappoints the customers it can reflect poorly on the original Rhode. It's a psychological game. It's like she wants to share in the light of the original Rhode and be able to deflect the blame in case she messes up with her brand.

She saw their potential and wanted the name, but they said no. And she took it anyway. It's theft no matter how things turn out in the end.

I’m surprised the clothing brand didn’t contest to her trademark application when she launched her trademark application. It’s a completely different category and the likelihood of anyone confusing both brands are close to none. So unless Rhode clothes have trademarked their brand name to also cover skincare category, the likelihood of them winning the lawsuit would be unlikely. And haylie isn’t stealing the name. You have every right to trademark a brand name is various categories you wished to be covered. I gather the clothing brand only chose to cover their category so they’re not protected if another brand with the same/ similar name sells on a completely different category. That’s just the law.

First she copies the Kardashians, steals Selena Gomez's boyfriend, then COPIES her as she tries to destroy her existence, then this spring/or last year she copied Selena Gomez AGAIN or another secret Woman, now she is getting sued for attempting to steal a trademarked name she KNEW about four years ago.

That young "lady" thought that because they were a small company, that she could somehow wheelbarrow over them because she had the money, power and status like the narc that she is. That somehow she could lie about "how it came to be" before the original company had the chance to protect their truth, taking their roots like a hurricane.

People really don’t understand how IP laws work. A clothing line and skincare line can both be trademarked under the same name without any infringement because they’re completely different producers! I’m usually for small businesses but this business is only doing this for some quick publicity.
