How to Save Layers in Photoshop

Can't do this, Export as is grayed out regardless of which layers I include. I've created a cut out that I inserted into another photo. I want to save the cut out (torso) as a single PS file, but it always ends up with a white or black background and not save it's transparency. The options you indicate are not made available in the process.
