You compare BetterHelp to Angie's List. The problem with that analogy is that BetterHelp is providing a medical service. Their providers should have a duty of care and so should BetterHelp.

the one good thing about this is that since we cant go to calss action then when they get hit by 1000 arbitration claims they will regret this course of action. just file the arbitration and watch this shit company flounder...

arbitration is a scam and should be illegal, they hired judge thats being paid by the company and so the judge almost always sides with the company who hired them, they may now force both parties t pay the judge, but it is still the company who seeks out and hired the arbitrator...

The real law is to respect any living creature on earth transition to this world , respect their beliefs as respecting them , and their families group etc , so that decides laws jurisdiction respect the water respect the forest respect the desert respect the city town etc then comes contract law again to respect the contract , common sense , rational, etc ,. So that's the international law , state providenses etc counties jurisdiction even beliefs people to respect and distance not only that but their property as well called the unsecured creditor,,, we don't chose who we are when we come to earth , etc , USA , state, nor race language ethic background religion nor beliefs ,, health when we come health backs us up people with mental disabilities or another issue their beliefs actions are in another level ,,the proper love Education can only,, help ,, so law is manipulation to help other people to learn that obey and or get screwed slavery, pay ,

You should NEVER get legal advice from anyone who doesn't practice/know/study the law. Also, there's the legal liability of your uncle giving legal advice well knowing he's committing legal malpractice and illegal practice of law without a license. Always, talk to your lawyer

discord have banned 2 of my accounts with "NO REASON"

as in they just state "hate speech" or TOS rules then give no exsample or proof

if i was using discord for BUISNESS and this happned losing all my contacts

i mean they should worry about beijng sued Discord should be Classed as a UTLITY and 230 protected company but ONLY able to terminate accounts if they are doing illigal things

any company based in america shouldn't be banning for Hate speech cos it's not illegal

Does anyone offer a service that gives a professional review of specific, individual ToS's. Even if I read them, my non-legal mind is unlikely to ferret out any real dangers therein. I worry that I may be picking up some kind of burden. Most of the time, I use the "Polish" mine detector method. Just close my eyes and ears and walk right through. I know there could be pitfalls for the provider of such a service, but surely, there is a way, a profitable way.

Old video and I'm chiming in from 2021, but I want to add that Discord paying the arbitrator's fee simply means they are buying a retired judge to rule in their favor. Any arbitrator that doesn't routinely rule in their favor will no longer be hired, thus their stable of arbitrators will be ones that know what the deal is.

The point to large class action judgments is not that class members get a big payout. That's not the goal of the litigation (not generally). The goal is to keep a bankruptcy-sized stick over the heads of large corporations in case they behave fraudulently. While there may be some exceptions, few of us expect large corporations to behave ethically without the threat of enforcement. That threat needs to be that big to keep groups like AT&T from just straight up ignoring their own promises (indeed, it's apparently not large enough a threat.) So Discord's statement is completely misunderstanding the purpose of these class actions. They are pursued not to redress damages, but to punish wrongdoing. And all of us have an interest in seeing that wrongdoing punished.

The risk of arbitration is that the big guy hires arbitrators a lot more often than the little guy, and so arbitrators have a vested interest in making the big guy happy at the expense of the little guy. If you don't make the little guy happy, you don't lose any business. If you don't make the big guy happy, you can potentially lose a lot of business. (And all the big guys are watching, not just the one you're dealing with.) This creates a very clear risk of bias that is not present in a real court. Does that bias ever manifest? I don't know-- my feeling is that it might not always, but that it does sometimes. Would be interesting to hear of any studies.

While broad disclaimers like BetterHelp's may be the norm, that doesn't mean that anybody shouldn't be careful about disclaimers or pretend like they don't matter. They do matter. A company that accepts liability for more failures is a more reliable company-- a company that is willing to stand behind their product. Matas can make any statements he wants about what their vetting is, but so long as the TOS says what it says, those words mean nearly nothing. If you want to know what a company does, look at what it refuses to accept responsibility for. The norm for modern gig companies is, well, to provide as shoddy of a product as they can get away with, in order to hire the cheapest, least qualified people they can get away with, in order to eke out some profit, so the fact that these disclaimers are also normal doesn't mean much. If BetterHelp wants to distinguish itself from the ugly horde of gig economy horror stories, they can start by accepting more responsibility than Uber does. And if they don't want to do that, it's 100% appropriate for people to bring their ToS to our attention.

FYI, for all the non-americans like myself out there: This is all US specific. Obviously this channel is dealing with US law specifically, but the reason I'm pointing this out is that the vast majority of weird terms that are found in US TOS would have zero chance of being upheld in a european court of law, and US firms often don't bother adjusting them for european markets so you end up with these TOS's that are full of effectively void terms.

Msi has one too, it went something like that, by agreeing with the ToS you agree to protect the company from any criticism and argue otherwise (take it with a big grain of salt, cause I don't remember it exactly!)
Edit: this is on the MSI app or where ever you sign in and can get rewards from buying their hardware
