ОтветитьIf we're going to talk seriously about the Second Amendment (2A), we need a serious understanding of much more than Jon Stewart's argument here. I love the guy immensely and greatly respect the tireless effort he puts into bettering America. However, he and every other commentator I've heard speak on 2A, despite their arguing skills and good intent, waltz right up to a door they never seem to walk through. Assuming anyone reads this and word spreads, I aim to remedy that here.
On a trip through a college library a few years back -- I was skulking around the place trying to determine which of my students actually went there -- I ran across a book on the subject of 2A, and as I grew up with guns in Texas and 2A has been something of a lifelong interest of mine, I decided to check it out and give it a read.
Short version : it damn near broke my brain.
I am an English professor and formal grammarian. I know my way around the language to a degree most people never even dream of, and I regard myself as a professional reader. This book, though, turned out to have been written both by and for formal 2A lawyers, judges and scholars, none of which I am, even in the least. It turned out to be an exceptionally hard read, taking me a solid month to slog through the whole thing. It served for me as a very basic introduction to what jurisprudence actually is. I really, honestly, had no idea at all of the full weight of that term until I forced my way through this one book.
If you read this book, here's part of what you'll learn a great deal about :
1) the history of the phrase "to bear arms";
2) the definition and function of a limiting clause;
3) the definition of "militia".
Be prepared for 100 dense pages on each subject. You may get more and you may get less; there are certainly other sub-topics, too. I just can't spit them all out on demand here and now.
Come out the other end and you'll have done something I've put before many other people in the past decade or so, and I've never heard back from a single one of them on it. Not a peep, not from a liberal or conservative, not from a Democrat or Republican, not from a centrist or Independent, not from a man, woman or beast. Just crickets. Not a goddamn word. That's why I started this commentary by referring to a "serious" intent. I know there's some out there somewhere. I've just never run into any of it in my own personal life.
The book is Uviller & Merkel's monstrous tome, "The Militia and the Right to Arms, or, How the Second Amendment Fell Silent (Constitutional Conflicts)". No, I'm not a paid agent, personal friend or casual acquaintance of either author. I'm just a guy who read a relevant book that no one else seems to care to tackle. Y'all have fun with it. Cheers.

ОтветитьAm I alone in thinking that the country with more guns than people, the highest gun crime in the world and the country that is most prone to chanting 'USA' might just be the problem? The exact people who claim it's the greatest country on the planet also claim they need guns for imaginary situations when their own government slaughters them. They don't seem to care about children being slaughtered at school despite that having actually happened.
I think maybe they're just a tad wimpy.
Simple remove guns from hands of civilians.
Every country which did that has succeeded. Check New Zealand or Australia

ОтветитьBut our right to bear arms was written into the constitution during a very different time. There is a thing where you can AMEND the constitution as society changes and evolves to better suit the current day society. We also don’t have a whole lot of control over broken households and fatherless men and overall control of how people think and act, but what we do have some control over is introducing some form of regulation which includes background checks so we can do what we can to minimize the amount of guns that get into the wrong hands which then increases the risk of higher gun crimes/deaths. Not sure why this concept is so hard for some people to understand.
