For a DUI defense attorney, the DMV hearing really serves 2 purposes. The first is to try to avoid a drivers license suspension. But the second is to use the DMV hearing as a forum to gather evidence and prepare the DUI case for court.

At the DMV hearing, the defense attorney can subpoena key evidence such as the patrol car dashcam, mobile digital transmissions, and maintenance and calibration records for the breathalyzer machine.

The defense lawyer can also question and cross-examine the arresting officer, getting him or her to admit police mistakes and things that are favorable to the defense case.
