ОтветитьMmm no, what people are entitled to depends on the basis on which they made their contribution. For example session singers and players nearly always work for hire. No royalty is owed. They could forego payment up front in return for royalty points but they undoubtedly know that the vast majority of music makes zero dollars.

ОтветитьQuestion.. I made a contract with my producer that he’s a work for hire. I pay him his fee and he produces the song and I own 100% of the rights. I wrote the lyrics, I came up with the chord progressions and I wrote the melody. He did the arrangements. Should I give him a percentage of songwriting credit even though we both agreed on the terms?

Ответитьim confused about something. the copyright registration process is for the 'sound recording' (form sr) - known as the 'masters'). and for the lyrics and musical notations (form pa) - which is known as the performing arts copyright [which includes the 'publishing rights']. why do you say the percentage of ownership of masters will always be IDENTICAL to the ownership of the publishing rights? this is not a hard and fast rule. say for example i am the soul author of the lyrics and musical notes and i performed the sound recording. in that case i would be 100% owner of the sound recording, or master. but that is independant of the 'publishing' side of things. if i know little to nothing about marketing my work on the publishing side of distribution - such as sheet music, sync usage fees, having other artists record my song - then it might be very attractive for me to have a 50%/50% split of profits by partnering with a music publisher. so in that case i would own 100% of my master, yet i might only own 50% of my publishing. can you elaborate?

Let's say my friend and me wrote a song (I was composer and arranger and my friend helped with the arrangement). For the recording, we asked his sister to record the vocals (she is the artist/performer).
In BMI (without a publisher), how do we split percentages? In my country, we don't enter percentage for performer in the submission because performing rights are subject to another regulations. We enter only creators (author of the lyrics, composser for melody and the arranger for the harmony).
The percentages are split by the regulations: composer gets the most, than the arranger and then the author it the lyrics. As you can see, it's oriented more towards the music creation.
Some clarity needs to be said in regards to this video. When we are talking about a "producer", we are NOT talking about someone who just "records the song / instrumental". In the context that NOT being said in the video, a producer has to have SOME of the creative involvement such as adding a melody line or extra bass line for example using the digital audio workstation (DAW) software... There are many songwriters who also act on their own as producers. Many producers are simply working in a recording engineer role in a recording studio. They record the song or instrumental as intended by the songwriter. Adding reverb, setting volume levels and mixing down tracks as normally done during recording of the song or instrumental, and as such doing that alone DOES NOT give a producer rights to royalties. This video implies that, and that is the wrong information to be disseminating to other new folks out here.

Ответитьit's a damn shame, that Music Arrangers only get a onetime flat fee for their great contribution to a HIT song. and get NO royalties on record sales. MOST of the time, it's their music on a record/song, that make it sound much better, and become BIG HITS. the Music Arrangers have ALWAYS been the most robbed individuals in the history of the Music Business...here are just a few GREAT Music Arrangers. Thom Bell, Paul Riser, Richard Carpenter, James Anthony Carmichael, Charles Stepney, Stanley Applebaum, Norman Whitfield, Benjimin Wright.

I'm a producer, and I sell my beats on beatstars. I've sold beats to dozens of artists. Yet only two have actually sent me publishing. One sent it to me no questions asked, and the other I asked and he kindly obliged. I tried asking a few more, but unfortunately I think I lost a few rappers' business over simply asking. Any advice? I don't wanna come across as a goon. But I do wish to collect the royalties that are spelled out in my contracts.
