Wouldn't the fact that content creators being required to accept the T&C just to upload to the platform, which allows premium users to download videos for offline use, automatically mean content creators are by default giving permission for their videos to be downloaded? That would mean they did not illegally download the video as you claimed. That is contingent on them having been a Premium user of course.

Perjury is a criminal violation not a civil one, and a civil action would be inappropriate. The letter the moron from Laniatus sent to Callum should be sent to the FBI as evidence of a confession to a crime, along with a statement of the circumstances under which the perjury was committed. Namely the YT take-down notice and any other correspondence Callum received from YT. This is more effective than any civil action, especially since the crime was committed and admitted to being committed by an individual, not by the company.

So the Kickstarter is gone, good. Their Discord is hilarious. They tried telling people:
" It is legally considered a crime for the parties related to the lawsuit brought against us to share information on the basis of information confidentiality and for third parties to share information on this subject."

In which people replied:

"It is not a crime to share information made available to the public, nor is it a crime to share personal opinions on it."

Troublesome Couchfuck has to learn the difference between news reporting and opinion reporting. A critic deals largely in their opinion about things. In other words, Callum was doing his job in looking at the game and giving his informed opinion about what he saw.

If so, IMHO, this is a misuse of the DMCA, which is ONLY for protecting one's copyrights -- who is allowed to make and distribute your tangible written, recorded, videotaped, or spoken words or sounds. It is not a legal device with which you may silence critics from, um... critiquing the work.

I’m late to this one (sorry Sid) but it’s funny every time someone says “Trademark” they never provide any hint of registration information. Something that so far as I know any lawyer talking about trademark will start with to establish validity and also create at minimum a point the alleged offender “knew or should have known” should offenses continue…

I watched a video recently, talking about taking notes while reading a book. Yellow highlighter, underlines, writing in the gutter -and all. I say that because of how skillfully you picked apart that ("Cuckill Figs") not so legal E-Mail. Yes, you write script(s) for videos, no duh that's exactly what notes are. I think the improper use of Trade Mark really ruffled your feathers and stood out within all that non-informational nonsense... Meaning, those words lack substance and structure; making your face contort with a stern look as your hair lights on fire.
Why must I write this comment- BECAUSE, Sid, I marvel at your ability to comprehend this and all Garbage Fire's. I salute you . . . keep up the fight.

It always amazes me how sid can find these terrible people to expose. Though lets be hinest the world isnt lacking in that department by any measure but still how can people be so stupid to think blatantly dtealing a game and calling it your own is a good idea? Im fairly certain though dont quote me on this exactly, but im certain people would not have minded the game at all if it was actually honest and admitted to being a remake to metin2 and derived heavy inspiration from it and compelled him to make a stand alone version of his modded server. Hell if he had just not had the kickstarter and made no money on it gameforge would have a hard time sueing because even though they could still sue for infringement, they wouldnt be able to say he gained monetary revenue from it and likely would have left him alone for a while. Either way amazing job as always sid, love the little rant at the end and hope that it disnt get under your skin to terribly much. Stupid is as stupid does so dont let the idiots get to you my guy. Very much excited to see how this all pans out.

One correction regarding free speech in the UK.
Article 10 of the human rights act means nothing it does not protect the speech of people who make any comment which can cause "harassment, alarm or distress" or one which is considered to be "grossly offensive", article 10 of the human rights act is regularly ignored and people regularly end up with lengthy prison sentences (months to years) for simply making mean comments on twitter.
Article 10 essentially has a get out clause where the article states that your right to free speech ends where the feelings of other people begin.
Also the European court of human rights never bothers to enforce it.

The UK desperately needs constitutionally protected speech. However parlaiment actively wants to destroy free speech, especially online, with their new "online harms bill" being the latest boot on the face of the public.

Having seen the reference to Chronicles of Elyria in the KS comments before it all got taken down, I wonder if this guy thinks of himself as another 'Caspian'... not realising that the issues with CoE arose after their crowdfunding was successful. Drawing attention to your obvious trademark-infringing project (that you've already been successfully sued over!) by attacking critics before you have a loyal group of backers & their money is so mind-bogglingly stupid it makes my head hurt. 🤦‍♀️
