For everyone out there and in particular aspiring lawyers, we are reminded that litigation is truly an art. Like all good art, the artist is bounded by rules. Those rules exist so that the lawyer can practice their art within the boundaries of those rules. Those rules assure (as best as possible) the timely, just, and inexpensive resolution of legitimate claims. Of course, the litigant in this case does not actually believe that rules exist or that he is subject to them. This is why, in my opinion, we have ended up with this travesty of an example of "litigation" and why we all get to witness an uncompromising and demanding federal judiciary in action. If we look at history as an example - Giuliani, Powell, Ellis, and Eastman to name a few of many, many more - we can extrapolate that Ms. Habba will be joining the list. What we are witnessing is a litigant and advocate who are both ignorant of and desecrate the law running up against the immovable object of procedural law as established by an appropriately exacting federal jurist.
