ОтветитьThe first one reminds me of the same punishment by someone else. A dad made his elementary school daughter walk to school for bullying. He kept an eye on her to make sure she made it all the way to school.

ОтветитьI’m passionately supportive of this kind of sentencing; convicted crimes should have options over prison time - however, I wish the stakes were raised, and not just applicable for misdemeanours, but for the felonies as well. The stakes should be raised.
These punishments are too cute. Nothing is far off over the line that it ventures into cruelty. These sentences are akin to what a student would opt to do at the principal’s request to avoid detention.
I do find our judicial/legal system inconsistent. Spraying the defendant with real pepper spray, up to par with what police use, ventured into “cruel and unusual punishment,” the judge said. But the death penalty doesn’t? Spending days, months and years in prison not considered cruel and punishment? Most would happily take real pepper spray to the face to avoid just 30 days in jail.
I’m certain that if a convicted of voluntarily manslaughter, by kicking his victim which resulted in his death, were facing up to 60 years in prison, and was given the option to smash four of his toes with a hammer without anaesthetic to avoid prison, he’d opt to smash his toes. These punishments would be preferred by defendants over serious prison time. If prison time was less of an unusual cruel punishment, defendants wouldn’t opt for it.
Time is the cruelest act of which the government can rob someone. Most would opt to take 30 lashings, an amputation, facial disfigurement, an opportunity to swim from contiguous Florida to Key West, to avoid time spent in prison.
