It's because Justins lawyer can and is asking for any doctor's records as evidence of her emotional distress, but if she gets it thrown out without prejudice she can come back at a later date and refile that claim, and if the discovery time has passed, Justins lawyer cannot ask for the evidence.

According to Katie from Without a Crystal Ball, BL dropping the emotional distress claim is all about money and not about SH. If you read what her lawyers wrote, they seem to be implying that they’re pursuing other avenues in the lawsuit that would prove to be more lucrative.
