ОтветитьThis is such a clear video thank you for this! I am looking to launch a POD Etsy store and researching the legal considerations presently. Can you please explain whether you can use quote from TV and Film if the programmes / films are copyrighted, but the specific quotes are not? I understand that there is a grey area of Fair Use and that you can use quotes if there is an 'original spin' on them - but I don't know if this means they can be lifted to put onto clothing for instance? Thanks in advance!

For example, I have seem many shirts saying "straight out of ___", which is by the group NWA. The original phrase is Compton but people are saying things like straight outtta bed or shape (in place of the last world Compton) .

ОтветитьI recently looked up a trademark and under goods and services it said "Providing home shopping services in the field of general merchandise.." but it didn't say the word shirt or clothing alone. It started of with providing services, although so of those services were "online retail store services" so is this more of the service and not the item itself? I'm a little confused on this. I'm worried about using the phrase but it seemed like I could actually technically use it. Any one help please! I'm new to this!

ОтветитьWhat would indicate that a font is trademarked on the tmsearch site? I’m looking to see specifically if the Barbie fonts (3) are trademarked, NOT using the word “Barbie”.
EDITING TO ADD: turns out you cannot trademark fonts, only the name of fonts. All you need is a proper commercial use license for that font.

ОтветитьLove your channel, but some info here is incorrect regarding the use of copyright/trademarked logos/brands. In a landmark 2013 case, the United States Court of Appeals for the 2nd Circuit, in the decision Cariou v Prince, ruled that works that were "transformative to a reasonable observer" were open to fair use. In that case, appropriation artist, Richard Prince, crudely manipulated a photograph of a Rastafarian man standing in a jungle (taken by photographer, Patrick Cariou) to show the man holding an electric guitar. According to the Court, this simple addition was "transformative," even though Prince, himself, did not argue that his work was transformative. Likewise, the inversion of a logo, combined with a similarly-opinionated commentary on the brand slogan, makes this appropriation "transformative" and protected by the 1st Amendment as a form of parody and free speech. The Court's continued protection of parody is why so many of these kinds of shirts exist. The ubiquitous smiley face tshirt with bullet holes is yet another example. Anyone can threaten anyone with legal action, but the owners of the copyright/trademark would be foolish to ever take such a case to court, especially in light of Cariou v Prince.
