It should not be criminalized. According to Honorable court in Joseph Shine vs UOI, to designate an unlawful conduct as a criminal offence all three factors/elements of 'Harm Principle' should be proven or fulfilled. In the case of Instant Triple talaq two elements which are 'wrongdoing' and 'harm' are being fulfilled but the third element i.e. 'public element' is not applicable because Instant Triple Talaq is a private act between Husband and Wife along with their families. If we see on practical grounds public is not getting effected by it so it's right to say that it is missing the public element hence, can't be criminalized.

Superb explanation but jab aap talaq e ahsan or talaq e hasan ke difference ko samajh jayenge tab aapki galat fahmi durr hogi ki dobara sadi karne ke liye halala mandatory hai.
